These Terms of Use ("Terms") govern the use of the mobile application BodyCount Calendar (the "App") provided by Markus Levi (the "Provider"). By downloading, installing, accessing, or using the App, you agree to these Terms.

1. Agreement With the Provider; Relationship to Apple

These Terms are an agreement between you and the Provider only, and not with Apple.

The Provider, and not Apple, is solely responsible for the App and its content, except to the extent otherwise required by applicable law.

If a matter is not addressed in these Terms, the Apple terms and conditions applicable to your use of the App Store and Apple’s standard licensed application terms may still apply.

Questions, complaints, or claims regarding the App should be directed to the Provider using the contact information above.

3. Eligibility

The App is not intended for children. You may use the App only if you are legally permitted to do so under applicable law.

4. License Grant

Subject to these Terms, the Provider grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, solely as permitted by the App Store usage rules and applicable law.

The App is licensed, not sold. All rights not expressly granted to you are reserved by the Provider.

5. App Purpose

The App is a private personal logging tool designed to help users record information related to sexual activity and PrEP, DoxyPrEP and DoxyPEP use for their own reference.

The App is provided for personal logging and informational purposes only. It is not intended to provide diagnosis, treatment recommendations, emergency guidance, or medical device functionality.

6. No Medical Advice

The App does not provide medical advice, diagnosis, treatment, or professional healthcare services.

Nothing in the App should be understood as a substitute for advice from a licensed physician, pharmacist, sexual health clinic, or other qualified healthcare professional. You should always consult a qualified healthcare professional before making medical decisions.

You must not rely on the App for emergency or urgent medical needs.

7. No Guarantee of Accuracy

The Provider does not guarantee that any information, reminders, dates, calculations, summaries, logs, or other outputs shown by the App are accurate, complete, current, clinically appropriate, or suitable for any specific purpose.

You are solely responsible for reviewing your entries and independently confirming any health-related information before acting on it.

8. User Responsibility

You are solely responsible for the accuracy, completeness, legality, and appropriateness of any information you enter into the App.

You are also solely responsible for how you interpret or act on any information displayed by the App.

9. No Accounts

The App does not require or offer user accounts.

Because there are no user accounts, the App does not provide account-based access, account recovery, account management, or account deletion workflows.

10. Local Storage and Optional iCloud Sync

The App is designed so that user-entered information is stored locally on your device.

The Provider does not operate a backend service for storing your private logs.

If you enable iCloud or related Apple synchronization features, certain App data may sync using Apple infrastructure associated with your Apple Account, subject to Apple’s own terms and policies.

11. Privacy Policy

Your use of the App is also subject to the applicable Privacy Policy made available by the Provider.

12. Feedback by Email Only

The App may provide a Feedback option that opens your email application with a draft message to the Provider.

Any message sent through that workflow is sent voluntarily by you outside the App, and you are responsible for the content of that communication.

You should avoid sending unnecessary sensitive health information or intimate personal information by email unless necessary to describe a technical issue.

13. Subscription

The App requires an active paid subscription ("BodyCount Calendar+") to access its features.

A 14-day free trial is available for new users.

Pricing: $19.99 per year, billed annually.

The subscription automatically renews at the end of each billing period unless canceled at least 24 hours before the end of the current period.

The free trial converts to a paid subscription upon expiration unless canceled beforehand.

If the subscription is not renewed, access to the App's features will be suspended until the subscription is reactivated.

Subscriptions do not create any entitlement to medical advice, personalized services, priority support, ownership rights, or guaranteed future features beyond those explicitly available at the time of purchase.

All subscriptions are processed and managed by Apple through your Apple ID account.

Billing, renewal, cancellation, and refund policies are governed by Apple's terms and conditions.

You can manage or cancel your subscription at any time in Settings → Apple ID → Subscriptions.

14. Acceptable Use

You agree not to:

- use the App in violation of any law or regulation;

- use the App to harass, abuse, or harm another person;

- reverse engineer, decompile, disassemble, modify, or create derivative works of the App except where such restriction is prohibited by law;

- interfere with the operation or security of the App; or

- use the App in a manner inconsistent with applicable third-party terms, including Apple platform terms.

15. Intellectual Property

The App, including its software, design, branding, text, graphics, and other content made available by the Provider, is owned by or licensed to the Provider and is protected by applicable intellectual property laws.

These Terms do not transfer any ownership rights to you except for the limited license expressly granted above.

16. Maintenance and Support

The Provider, and not Apple, is solely responsible for providing any maintenance and support for the App, if any is provided.

Apple has no obligation whatsoever to furnish any maintenance or support services for the App.

17. Warranty Disclaimer

To the maximum extent permitted by applicable law, the App is provided "AS IS" and "AS AVAILABLE," with all faults and without warranties of any kind.

The Provider disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, availability, title, and non-infringement.

The Provider does not warrant that the App will be uninterrupted, error-free, secure, or free from loss, corruption, delay, or inaccuracy, or that it will meet your expectations or medical, personal, or legal needs.

Some jurisdictions do not allow certain warranty exclusions, so some of the above exclusions may not apply to you.

18. Product Claims

The Provider, and not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar laws.

19. Third-Party Intellectual Property Claims

In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, the Provider, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim, to the extent required by these Terms and applicable law.

20. Limitation of Liability

To the maximum extent permitted by applicable law, the Provider shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to the use of or inability to use the App, even if advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the total liability of the Provider for all claims arising out of or related to the App or these Terms shall not exceed US$50.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

21. Export and Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with all applicable laws and regulations in connection with your use of the App.

22. Third-Party Beneficiary

You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

23. Termination

These Terms remain effective until terminated by you or the Provider.

Your rights under these Terms will terminate automatically if you fail to comply with these Terms.

Upon termination, you must stop using the App and delete all copies of the App in your possession or control.

24. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of laws principles, except to the extent superseded by applicable mandatory law.

25. Changes to the App and Terms

The Provider may modify, suspend, or discontinue all or part of the App at any time, to the extent permitted by applicable law.

The Provider may also update these Terms from time to time. Continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by law.
